PLAN COMMISSION


INFORMATION AND REQUIREMENT

REZONE/CONDITIONAL USE PERMIT/VARIANCE/SPECIAL EXCEPTION PERMIT/PRELIMINARY CERTIFIED SURVEY MAP/FINAL CERTIFIED SURVEY MAP


1. All requests start with the applicant contacting the Town office and obtaining an application and site plan form. The Town office is located at 7161 County Highway I; DeForest, WI 53532-1946 . Telephone: (608) 846-3800. Fax: (608) 846-3829. E-mail: rpulverm@execpc.com Office hours are: 8:30 AM until 5:30 PM, Monday through Friday.

2. You will be given the name and telephone number of a person on the Plan Commission who will serve as your "contact person." You can contact this person for information and answer any questions you may have.

3. The application for (filled out completely), site plan and any required attachments must be returned to the Clerk, along with a $25.00 application fee made payable to the "Town of Vienna," by the deadline date in order for the request to be placed on the next available agenda. If your request involves a land division, a fee of $15.00 plus $2.00 per lot is required and due at the time of application.

4. There is a nine-item limit to the agenda. (First come/first serve basis.)

5. When a request appears on the Plan Commission agenda and no one appears at the meeting to represent the request, action may or may not be taken.

6. The Plan Commission meets at 7:00 p.m., the first and third Monday of the month at the Town Hall, 7161 County Highway I; DeForest, Wi. In most cases the Plan Commission will hear new requests at its first Monday of the month meeting and discuss and consider a recommendation at the third Monday of the month meeting.

7. The Plan Commission consists of five members. In order to expedite the decision-making process, it is suggested that any materials that would be helpful to members be given to the Clerk at the time the application form is submitted for distribution prior to the meeting. If materials are presented at the meeting, eight (8) copies must be provided.

PRELIMINARY ACTION

1. The first time a request is brought before the Plan Commission, it is reviewed for consistency with the Town Land Use Plan. A motion on a request may be made and voted on by Commission members for preliminary approval or disapproval.

2. The Commission reports the actions they take on their agenda items to the Town Board on the third Monday of the month, unless otherwise noticed. The Town Board considers action based on input from the Plan Commission. A motion on a request may be made and voted on by Town Board members for preliminary approval or disapproval. (The Plan Commission is advisory to the Town Board. The Town Board's action may differ from the Plan Commission's.)

3. The Town of Vienna usually does not notify Dane County Zoning of preliminary action taken on requests.

4. The petitioner may now proceed to file an application with Dane County Zoning.

FINAL ACTION

1. When you apply at Dane County Zoning you will be given a public hearing date to appear before the Dane County Zoning and Natural Resources Committee. Landowners within 1/4 mile receive a notification of the Public Hearing regarding your request. After the Town receives a copy of the Notice of Public Hearing your requests is placed on the next possible Plan Commission agenda (that follows the Public Hearing date) for final approval or disapproval.

2. The request, as submitted to Dane County, will be reviewed by the Plan Commission and a motion for approval or disapproval may be made.

3. The Plan Commission reports the final action they have made on the request to the Town Board on the third Tuesday of the month, unless otherwise noticed. The Town Board considers its final action based on input from the Plan Commission. A motion on your request may be made and voted on by Town Board members for final approval or disapproval. (The Plan Commission is advisory to the Town Board. The Town Board's action may differ from the Plan Commission's.)

4. The Town Board notifies Dane County Zoning, in writing, of final action taken on your request.

PRELIMINARY CERTIFIED SURVEY MAP AND CERTIFIED SURVEY MAP

1. The "Driveway Placement Form" must be completed, approved and signed by the Road Supervisor and submitted to the Clerk prior to approval of your Preliminary Certified Survey Map. You can set up an appointment with the Road Supervisor, Carlton Hamre by contacting him by phone at (608) 846-3227.

2. The Preliminary Certified Survey Map will be placed on the Plan Commission agenda for review and action when the Town receives a copy of the map from Dane County Zoning. The Town Board will also review the map and forward requested changes to Dane County Zoning.

3. The Certified Survey Map will be placed on the Plan Commission agenda for review and action when the Town receives a copy of the map from Dane County Zoning. Final approval of a rezone will be contingent on Town Board approval of the Certified Survey Map. The Certified Survey Map must include any required restrictions and/or conditions, show driveway placement and include a Town of Vienna Approval Certificate.

SPECIAL EXCEPTION PERMITS AND VARIANCES

1. The Dane County Board of Adjustment will not accept any permit applications unless they are accompanied by a letter informing them of Town action on the request.

2. The Town of Vienna is advisory only on these requests.

3. Final action by the Plan Commission and Town Board is usually taken the first time a request appears on the agenda.

HOUSE REPLACEMENT AGREEMENT FORM

Within 30 days of completion of the replacement home, all household personal property must be relocated to the replacement home.

Within 30 days of occupancy of the replacement home, the water supply, plumbing and sewer access in the old home must be disconnected.

The old home shall be considered unlivable, obsolete and destroyed for no monetary value by the owner within 90 days of occupancy of the replacement home.

If the owners of said property are authorized a building permit by approximately ___________________________ , construction of the replacement home will be completed by approximately ____________________________ .

Your signature on this document will be a confirmation of your approval and future compliance of this agreement. Failure to comply with the terms and conditions of your agreement may necessitate enforcement action by the Town or County at some time in the future.

PLAN COMMISSION POLICIES


EMERGENCY ACTION

1. Any emergency action will be determined jointly by the Plan Commission Chairperson and the Vice-Chairperson.


PRELIMINARY APPROVALS

1. When granting preliminary approval, the Plan Commission shall remind petitioners that they have received PRELIMINARY APPROVAL only and that their request will appear on a future agenda following the Dane County Public Hearing for final approval.


FINAL APPROVALS

1. Final approval of rezones or any other requests, which require a Certified Survey Map, will be contingent on approval of the Certified Survey Map by the Plan Commission and Town Board. The Plan Commission and Town Board will state this contingency in their motions for final approval. The Town Board Action Report submitted to Dane County will be used to document this contingency in writing.

2. Final approval of a petition will take place within 30 days of the Dane County Public Hearing. (The Town has 30 days from the date of the Dane County Public Hearing to respond or it loses the right to.)



PRELIMINARY CERTIFIED SURVEY MAPS

1. The motion for approval of Preliminary Certified Survey Maps must include the following conditions for the Certified Survey Map:

  1. Driveway placement must be shown
  2. Must include a Certificate of Town Board approval

2. Preliminary Certified Survey Maps require Plan Commission and Town Board approval.

3. Only Preliminary Certified Survey Maps received from the Authorized Representative of the Dane County Zoning and Natural Resources Committee will be considered for approval by the Plan Commission and Town Board.


CERTIFIED SURVEY MAPS

1. Certified Survey Maps require Plan Commission and Town Board approval.

2. The Certified Survey Maps must include a Certificate of Town Board approval and show driveway placement.

3. Only Certified Survey Maps received from the Authorized Representative of the Dane County Zoning and Natural Resources Committee will be considered for approval by the Plan Commission and Town Board.


DEED RESTRICTIONS

1. A Deed Restriction for no further development must be placed on petitions where it is determined that the last building right has been used.


MISCELLANEOUS

1. The Plan Commission shall remind petitioners to appear at the next Town Board meeting, as their actions are advisory.

SITE PLAN

Please present a drawing of your requested site plan, with as much detail as possible, including the following: names of roads adjacent or near property, location of present and/ or requested buildings, existing and/ or requested driveway locations, woods, water or any other significant physical attributes.
