All Highway Preparation, Construction and Dedication
Expense will be borne by the applicant(s). Prior to the preparation and/or
construction of any highway to be dedicated to the Town of Vienna, the
applicant(s) should notify the Town Board. An "on-the-site" meeting will
then be arranged to be attended by the Town Board and the applicant(s).
The proposed roadway must be at least sixty-six (66)
feet in width, properly graded and ditched as specified by the Town officials,
with a maximum grade of 8 degrees. The road bed must be at least twenty-eight
(28) feet wide and covered with eight (8) inches of crushed rock, properly
compacted. Suitable culverts, as specified by the Town officials will
be required to handle any necessary cross-road drainage.
If the road "dead-ends", a fifty (50) foot turn-around
is mandatory. The road bed will be covered with Hot-Mix Asphalt, per State
specifications, at least twenty-two (22) feet in width and a minimum thickness
of 2-1/2 inches (1-1/2 inch binder course, plus 1 inch surface course).
The finished road must meet the approval of the County Highway Commission.
DEDICATION.
The applicant(s) and/or his attorney is referred to
in Sections 80.02 to 80.09 inclusive of the Wisconsin Statutes. The applicant(s)
will prepare all legal notices required.
- 80.02: The applicant(s) will present a
petition to the Town Clerk signed by six (6) or more resident free holders
and containing a complete legal description, survey, and map of the
property, requesting the Town Board to lay out a Highway.
- 80.05: On receiving said petition, the
Town Board will meet and set a time and place to decide on the application.
This notice shall also specify the legal description of the Highway
to be laid out. Particular attention is directed to 80.05 (2).
- Notice by registered mail to all occupants and owners of record
of land through which Highway must pass
- Notices to State Conservation Commission and State Soil and Water
Conservation Committee
- Publish a Class 2 Notice under CH#985.
- 80.06: The Town Board decides an application..........
- 80.07: Applicant(s) will prepare an Order
Laying Out a Highway to be signed by the Town Board and the Town Clerk.
It will again contain a Legal Description. It will also state that the
provisions of 80.02, 80.05 and 80.06 have been executed. A certified
copy shall be prepared for transmittal by the Town Clerk to the County
Highway Commissioner.
- 80.09: The applicant(s) will secure a Release
of Damages from all occupants and owners of record and present it to
the Town Clerk. A Land Conveyance shall accompany the Release of Damages,
all properly recorded by the Register of Deeds.
PERFORMANCE BOND.
The applicant(s) may desire to prepare the Highway
(grade, ditch and gravel, etc.) one year and "black-top" it the next year
in order to further "compact" the road bed. If so, applicant(s) will provide
a bond ($2 per foot), which would enable the Town to finish the road,
in case of default by the applicant(s).
The above shall take effect from and after its passage
and posting as provided by law.
The foregoing was adopted at a regular meeting of
the Town Board of the Town of Vienna on July 12, 1972.
