ORDINANCE SUBDIVISION ROADS
11/12/74
REGULATION OF ROAD LAYOUT AND ACCEPTANCE OF SUBDIVISIONS
 

The Town Board of the Town of Vienna, Dane County, Wisconsin, pursuant to authority vested in it does hereby ordain as follows:

SECTION 1.
No road or highway not a part of a subdivision shall be accepted or laid out by the Town Board of the Town of Vienna unless such road or highway is at least sixty-six (66) feet in width. In addition to the foregoing provision relating to width of such road, no road shall be accepted or laid out by the Town Board of the Town of Vienna unless such road be constructed in accordance with the specifications set forth at SECTION 3 hereof.

SECTION 2.
No plat of any subdivision shall be approved by the Town Board of the Town of Vienna pursuant to Chapter 326 of the Wisconsin Statutes unless such plat shall provide that all roads, lanes, highways or other public ways shown thereon shall be at least sixty-six (66) feet in width, except as provided hereafter in SECTION 4.

SECTION 3.
Prior to the acceptance of the subdivision plat as described in SECTION 2, the subdivider shall enter into a contract with the Town that the roads, lanes, highways or other public ways shown thereon shall be constructed in accordance with the following specifications:

  1. The roads, lanes, highways or other public ways shall be graded in conformance with the "Town of Vienna Road Standards" shown in the "Typical Cross Section" on the last page of this Ordinance.
  2. The base course of such road, lane, highway or other public way shall consist of crushed rock conforming to the latest Standard Specifications for Road and Bridge Construction as published by the State of Wisconsin Department of Transportation, Division of Highways.
  3. The surfacing of such road, lane, highway or other public way shall consist of a minimum of 2-1/2 inches of hot mix bituminous concrete to comply with the latest Standard Specifications for Road and Bridge Construction published by the State of Wisconsin, Department of Transportation, Division of Highways.
  4. Wherever the contours of the land make it necessary that drainage waters be carried across any road, lane, highway or other public way, a culvert approved as to size and length by the Town Board shall be installed; in no case shall the culvert be less than eighteen (18) inches in diameter.
  5. Easements shall be provided for all drainage waters wherever in the estimation of the Town Board such easements may be necessary.

SECTION 4.
Every dead-end road, lane, highway or other public way shall be provided with a temporary cul-de-sac at least 120 feet in diameter of right-of-way and a minimum of seventy-five (75) feet in diameter of bituminous surfacing. No permanent driveways shall be allowed from temporary cul-de-sacs.

SECTION 5.
The Town Board, as a condition precedent to the approval of the subdivision, shall require the subdivider to file a performance bond with the Town Clerk guaranteeing compliance with the terms and conditions of the contract specified in SECTION 3 hereof. Such bond shall be in such amount and with such sureties as shall meet with the approval of the Town Board. The Town Board, as a condition precedent to the acceptance of any lands for highway purposes, may require a bond for the performance of the work to be done as provided for herein on said road in lieu of actual performance of the work prior to the acceptance thereof.

SECTION 6.
Whenever special conditions exist with respect to the terrain, soil conditions, or type of vehicles using the roadway the Town Board may require additional specifications for the road to be built in accordance with good engineering practices as may be required by the Town Board or an engineer appointed by the Town.

This ordinance shall take effect from and after its passage and posting as provided by law.
