INTRODUCTION.
Pursuant to law and to Section 101.65, Wisconsin Statutes,
this Town Board of the Town of Vienna does hereby ordain a building code
as follows:
An Ordinance to create Section A of the building code
of the Town of Vienna, Code of General Ordinances, establishing a building
code for new one- and two-family dwellings by adoption of Wisconsin Administrative
Code Chapters:
IND 20 Administration and Enforcement
IND 21 Construction Standards
IND 22 Energy Conservation
IND 23 Heating, Ventilating and Air Conditioning
IND 24 Electrical Standards
IND 25 Plumbing and Potable Water Standards
and to renumber to Section B of the existing Building Code of the Town
of Vienna.
1.1 ADOPTION OF WISCONSIN
UNIFORM DWELLING CODE.
Section A of the Building Code of the Town of Vienna, Code of General
Ordinances, is hereby created to read as follows:
Section A:
- Chapter Ind 22, Wisconsin Administrative Code, Energy
Conservation Standards of the One- and Two-Family Dwelling Code, as
adopted and effective December 1, 1978 and Chapters Ind. 20, 21, 23,
24, and 25, adopted and effective June 1, 1980, and all amendments thereto,
are adopted and incorporated in this code by reference.
- The Building Inspector, as certified by the Department
of Industry, Labor and Human Relations, is hereby authorized and directed
to administer and enforce all of the provisions of the Wisconsin Uniform
Dwelling Code.
- Any existing ordinances pertaining to the construction
of new dwellings that conflict with the Uniform Dwelling Code are hereby
repealed only insofar as such existing ordinances relate to matters
covered by the Uniform Dwelling Code.
1.2 APPLICATION OF SECTION
A OF THE BUILDING CODE
TO ALTERATIONS AND ADDITIONS TO EXISTING
DWELLINGS.
The provisions of Section A of the Building Code shall
apply to any and all alterations or additions to existing dwellings or
dwelling units, as defined in said Section A, commenced on or after the
effective date of this ordinance.
1.3 BUILDING PERMIT REQUIRED
- SECTION A OF BUILDING CODE.
For purposes of Section A of the Building Code, no person shall build
or cause to be built any one- or two-family dwelling without first obtaining
a state uniform building permit for such dwelling. Such building permit
shall be furnished by the Town. A copy of such permit issued shall be
filed with the Town Building Inspector.
1.4 BUILDING PERMIT FEES
- SECTION A OF BUILDING CODE.
For purposes of Section A of the Building Code, the building permit fees
shall be determined by resolution of the Town Board from time to time.
No building permit shall be issued unless the fees have been paid to the
Building Inspector. For purposes of establishing initial building permit
fees, those fees shall be in the amount set forth in Exhibit 1 attached
hereto.
1.5 PLUMBING AND ELECTRICAL
PERMITS.
In addition to all fees and permits mentioned herein before, no person
shall build or cause to be built any building or structure in the Town
of Vienna containing any plumbing or electrical connections without first
obtaining from the Town or its designee, plumbing and/or electrical permits
upon forms as may from time to time be designated by the Town Board and
pay fees therefor in amounts designated from time to time by the Town
Board. For purposes of establishing initial plumbing and electrical permit
forms and fees, said fees and permits shall be as set forth on Exhibit
2 and 3 hereof.
1.6 RENUMBERING OF EXISTING
BUILDING CODE OF TOWN OF VIENNA.
The existing Building Code of the Town of Vienna is hereby renumbered
as "Section B" of the Building Code of the Town of Vienna.
1.7 APPLICATION OF SECTION
B OF THE BUILDING CODE.
Section B of the Building Code shall apply in all respects to any construction,
addition, alteration or other matter which is not covered by Section A
of such Code or which has been expressly exempted from coverage under
said Section A, including, but not limited to, privies, privy vaults,
waterless toilets, moving of buildings and penalties.
1.8 BUILDING PERMIT FEES
- SECTION B OF BUILDING CODE.
For purposes of Section B of the Building Code, the building permit fees
shall be determined by resolution of the Town Board from time to time.
No building permit shall be issued unless the fees have been paid to the
Building Inspector. For purposes of establishing initial building permit
fees, those fees shall be in the amount set forth in Exhibit 1 attached
hereto.
1.9 PENALTIES. The Town
Board shall provide for the enforcement of Sections A and B and all other
laws and ordinances relating to buildings by means of the withholding
of building permits, imposition of forfeitures, injuncture actions or
any other rights and remedies provided for by law or in Sections A and
B.
1.10 SEVERABILITY.
If any section, clause, provision or portion of this ordinance or Wisconsin
Administrative Code Chapters Ind 20, 21, 22, 23, 24, and 25 is adjudged
unconstitutional or invalid by a court of competent jurisdiction, the
remaining provisions shall not be affected thereby.
1.11 CERTIFICATE OF OCCUPANCY.
No building hereafter erected shall be used or occupied in whole or in
part until all inspections required hereunder have been made and the Building
Inspector has issued a Certificate of Use and Occupancy upon such forms
as may be designated by the Building Inspector.
This ordinance shall take effect April 1, 1981, upon
passage and publication. Adopted this 24th day of March, 1981.

EXHIBIT 1.
The permit fees shall be as follows:
- Fees for permits for new single family homes and duplex
residences shall be Two Cents ($.02) for each square foot of floor area,
including basements and attached garages.
- For all new construction, except for single family homes
and duplexes, and for all additions and alterations to existing buildings
that cannot be calculated by square footage, the fee shall be One Dollar
and Fifty Cents ($1.50) for each One Thousand Dollars ($1,000.00) of
construction costs, mechanical costs not included.
- The minimum fee for any permit is Five Dollars ($5.00).
- In addition to any other fee, the permit fee shall include
any and all fees required under Ind. Chapter 69 of the Wisconsin Administrative
Code.
